According to the EMS Chief, and the County judge. The photo is considered horseplay, and the people involved received a written warning.
The mother says it was misinterpreted, but many citizens of Kermit say regardless, its still wrong.
At first glance, this photo disturbed many people in Kermit, a girl tied to an EMS stretcher, her mouth duct taped while water is poured on her.
"That should not be horse-play doing that to a kid, not even to an adult."
"Even if it was horse play what if something gets out of hand and something happens."
But the family says the photo has a story behind it. The mother Brandy Slayton says she works a 24-hour shift as an EMT and her family visits her every evening.
She says her daughter was curious about how the EMS stretcher worked.
“We put some tape on her because she was hollering, and we were just having a good time,” Slayton said.
Slayton says her husband jokingly poured a little water on their daughter.
That’s when she snapped a picture at the wrong time, posted it on Facebook, and then it went viral.
"I don't think along those lines as an abuser, so I didn't think of that when I saw it," she said.
EMS Chief James Everett says although the incident shouldn't have taken place at the EMS building, he sees the photo as no more than family time.
“We saw it as horseplay between family members,” he said. “Who hasn't played with their family and it gotten out of hand?”
Jana rushing agrees she says knowing the EMS workers, they meant no harm
“I know them personally and I don't see that happening.”
“Find out the truth before talking to other people,” Everett said, “Gossip feeds itself.”
CBS 7 spoke with the daughter on the phone. She was laughing about the incident and says she wants to put everything behind her.
